Terms for booking and production inquiries
Scope
These Terms & Conditions ("Terms") apply to all contracts between DJ Da Trooth (hereinafter "DJ") and the client (hereinafter "Client") concerning the provision of DJ and other musical services.Conclusion of Contract
The contract between the DJ and the Client is concluded when the Client accepts an offer from the DJ, either in writing or electronically. A binding contract becomes effective upon the DJ's confirmation of the booking.DJ's Services
The DJ undertakes to provide the DJ services at the agreed time and location in accordance with the details stated in the booking confirmation. The service generally includes playing music and shaping the event's atmosphere.Fees
The fee for the DJ service is set out in the booking confirmation. Payments are due as follows:A deposit of 25% of the total amount is due 14 days before the event, unless otherwise agreed.
The remaining balance is due immediately, but no later than 5 days after the event.
Cancellation
Cancellation by the Client
The Client may cancel the booking free of charge up to 30 days before the agreed event date. For later cancellations, the following applies:Cancellation up to 30 days before the event: 10% of the agreed total amount is payable.
Cancellation up to 14 days before the event: 50% of the agreed total amount is payable.
Cancellation less than 7 days before the event: the full amount is payable.
Cancellation by the DJ
The DJ may terminate the contract for good cause (e.g. illness, unforeseeable events, force majeure). In this case, any amount already paid will be refunded in full, or an attempt will be made to find a suitable replacement. If this is not possible, the obligation to perform lapses and the Client will receive a refund of payments made.
Force Majeure
If the event cannot take place due to force majeure (e.g. natural disasters, war, etc.), both parties are released from their obligations. Payments already made will not be refunded in this case.Liability
The DJ is only liable for damages caused by gross negligence or intent. Liability for damages caused by third parties or unforeseeable events is excluded. The Client undertakes to ensure that the DJ has a safe working environment and that there is no risk to safety.Use of Music
The Client shall ensure that no copyright infringements occur in connection with the event and assumes responsibility for any third-party claims.Technical Equipment and Requirements
The DJ is responsible for providing the necessary music equipment. Should the Client provide their own equipment, it must be in proper working condition. Any additional costs for necessary equipment will be invoiced to the Client.Data Protection
The DJ undertakes to treat all personal data of the Client confidentially and to use it only within the scope of contract performance. Disclosure to third parties will only take place with the Client's express consent, except in legally required cases.Final Provisions
Should any provision of these Terms be or become invalid or unenforceable, the validity of the remaining provisions shall remain unaffected. Amendments and additions to these Terms require written form. German law (BGB) applies, even if the contract was concluded outside of Germany.
